Caution

As a result of its investigation of a formal complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. Kershen Hulbert as follows:

•    As a dentist, Dr. Kershen Hulbert must remember that her conduct, particularly her public advertisements, has a direct impact on the perception of the profession. As such, she must keep in mind how her promotional associations reflect on the dental profession as a whole. 

•    Dentists in Ontario must adhere to the limits on advertising as set out by the College through regulations and guidelines. 

•    It is not acceptable to abdicate responsibility for adhering to the advertising limits set by the profession to a third party and not monitor the final result for compliance with these limits. 

•    Dr. Kershen Hulbert knew that she could receive guidance from the College directly in respect to promotional schemes and yet chose not to solicit this guidance in respect of this particular promotion.

Caution

As a result of a complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. Kershen Hulbert as follows:

• Dr. Kershen Hulbert must ensure that her records, which must reflect her clinical observations and judgment, support the use of fees she bills and claims she issues to insurance companies. When treatment is provided and billed or claimed shortly after other, similar treatment – for example, two appointments that appear to be similar or units of scaling – there must be clinical justification for doing so and that justification must be clearly documented in the patient record. Further, when the fees for treatment are associated with units of time, care must be taken to ensure that the amount of time spent corresponds with the number of units billed or claimed.
