As a result of an investigation, the Inquiries, Complaints and Reports Committee decided to caution Dr. Ivan Tucakov as follows:

• All dentists are required to maintain current knowledge of the College’s Standards of Practice, Guidelines and Practice Advisories, as well as any other information distributed by the College. Dr. Tucakov failed to do so when he provided oral moderate sedation without member authorization and a facility permit, contrary to the College’s Standard of Practice: Use of Sedation and General Anaesthesia in Dental Practice.  He also failed to meet the requirements of the Standard of Practice with respect to emergency drugs and equipment and recordkeeping.  The member is cautioned to ensure that he adheres to the College’s Standard of Practice with respect to sedation, and to cease providing sedation if he cannot meet the requirements of the Standard of Practice.

As a result of a complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. Ivan Tucakov as follows:

• Prior to commencing treatment, it is imperative that you fully discuss with your patient the nature of the proposed treatment, including the risks, benefits, the prognosis and alternative treatment options. You should document in the clinical notes the details of this discussion and the patient’s decision, even when the patient has signed a consent form.

• As a dentist in Ontario, you have legal, professional and ethical obligations to ensure that you are billing accurately. You cannot charge a patient for a service until the service has been rendered. The Committee was disappointed to see that you inappropriately billed the patient in this matter for a prosthetic (i.e. dentures) before the delivery of the prosthetic, particularly when, in a prior decision issued October 3, 2022, the Committee had identified a similar situation where your office billed crowns and a bridge before the insertion date.
