As a result of a complaint, the Inquiries, Complaints and Reports Committee decided to caution Dr. Marius Beca as follows:

• The inappropriate and unprofessional nature of the emails sent to a staff member who was also his patient, which were sexually explicit. These emails were a serious breach of patient and professional boundaries. It is incumbent upon the member to establish and maintain appropriate boundaries with patients and staff given the power imbalance between a dentist and patient as well as a dentist and staff member. The member is cautioned that he should reflect on his decision to send this type of emails communication to a staff member who was also a patient and ensure that in the future, if he determines that email communication is needed with staff or patients, that it is both appropriate and professional in both delivery and content.

• While the conduct in this case occurred more than 15 years ago, the panel believes that the dentist’s conduct in this matter was a serious transgression of his professional boundaries with a staff member who was also a patient. The emails sent by the dentist are as offensive and misogynistic now as they were at the time that they were sent. The member is cautioned about the need to maintain professionalism in the workplace throughout all of his communication given his position of privilege with specialized knowledge on which the staff and patients rely.

• It is imperative that the dentist learns from this experience and the course he will take on boundary issues to ensure that his future conduct is consistent with the College’s current guidance documents on sexual abuse prevention and social media.
